proposed definition of acceptable public nudity

| I believe laws requiring clothing come from an unfounded, even superstitious fear of our own bodies. People believe being seen or seeing someone naked has some kind of harmful effect. Yet no harmful effect is possible. It is worse than a fear of the dark....people need to grow up. | |
| The difficulty in setting a "definition" is couched in the general public's conception that nudity/nakedness equals sexual behavior. Then there are the fanatics that preach that nakedness is the path to evil. In Colonial times, the Puritans believed that witches danced naked around their cauldrons while casting the spells! The end result is today's confusing and restrictive laws, set by persons of the above mindsets. Most of us believe that nudity, in and of itself, should not be illegal, but sexual displays and behaviors should. Convincing the lawmakers of the difference is the mountain we have to climb. | |
| The way the laws are actually written in most states are technically nude-friendly, as the offense of indecent exposure or other name includes the requirement that the offender has the purposeful intention of causing affront or sexual gratification in conjunction with the exposed genitals, and therefore simply being nude without the intention of causing offense is not illegal. Unfortunately, most police and judges too automatically assume nudity is always an intention for sexual gratification or to cause offense. Therefore, it's not the law itself that needs to change, but the public's awareness and public opinion on nudity that actually needs to change. | |
| Well said, Sanman. Yes, it is the perception of those who witness a nude person which creates the problem, not the laws themselves. But, how do we change those perceptions which have been so ingrained in society for so many years? Jim | |
| Changing deeply held attitudes does seem a daunting task. However, the gay community has seem to have done it in our lifetime. San Francisco seems to have succeeded. The naked bike and naked fun runs seem to help. Maybe more resorts will help too. Every time I try to get something going, the push back I get is why bother? Its not important enough to most people to push for change. |
